The Justice Department issued a formal target letter to Marc Elias on Tuesday, marking a sharp escalation in its criminal investigation of the Alaska Senate race.

Elias, a prominent Washington attorney who has represented Democratic campaigns for years, received the notice on Election Day. Two people familiar with the matter said the department also sent similar letters to other individuals. These recipients are now considered at substantial risk of indictment under the department's guidelines.

The inquiry centers on a name collision that has complicated the state's election. Republican incumbent Dan Sullivan shares a first name with a retired teacher, Dan J. Sullivan, whom the campaign of Democratic former Rep. Mary Peltola reportedly tried to recruit.

Alaska U.S. Attorney Michael Heyman told reporters in Anchorage that the probe has been active for several months. He noted that recent reports from The New York Times regarding the Peltola campaign's efforts triggered a rapid increase in law enforcement resources deployed to the state.

More than 100 subpoenas have been issued as part of this effort, according to one person briefed on the case. The Justice Department defines a target as a person against whom it has gathered substantial evidence linking them to a possible crime.

Elias responded to the news with a public statement. He called the move an act of political weaponization against the administration's opponents. "No one should be surprised that President Trump’s Department of Justice is targeting me and my law firm on Election Day," he said.

Despite the formal status, a target letter does not guarantee an indictment. The administration has faced difficulties securing grand jury indictments in other politically sensitive matters. Elias said he would not be intimidated by what he described as a sham investigation.

The race in Alaska is one of a handful of contests expected to determine control of the U.S. Senate. Sullivan and Peltola remain the primary candidates in a contest that has drawn national attention due to the legal complexities surrounding the shared name.
